Probate is a legal process which involves proving the validity of the will; identifying all of the estate owned by the decedent; evaluating the estate; settling existing debts or liabilities; and transferring assets to the rightful beneficiaries. In Maryland, there are two types of estates:
- Regular estate: The estate is worth more than $50,000.
- Small estate: The estate is less than $50,000 in value.
To file for a probate case in Maryland, the following documents are required:
- The will of the deceased
- Death certificate
- Funeral bill
- Approximate value of various assets under the deceased's name
- Title documents for the deceased's car and/or other motor vehicles
- Proof of the deceased's property
- Documentation of other property of the deceased
- Information on persons related to the estate
